Welcome to shop.designtrust.hk - the website operated by DESIGN TRUST (the "Site") powered by GOLS.

By placing an order with DESIGN TRUST ("DESIGN TRUST", "we", "us" or "our") for products which are sold on the Site ("Products") you will be deemed to have read, understood and agreed to these Terms and Conditions ("T&Cs"). Please read these T&Cs carefully and, if you are unhappy with any aspect, you should contact us via epopup@designtrust.hk before placing an order with us.

Eligibility

In order to make a purchase through the Site or to use any of the services or features made available to you on our Site you will be required to accept our T&Cs and register. When you register, you will be required to provide information about yourself including, but not limited to, your name, telephone number and email address, which is true, accurate, current and complete in all respects. Furthermore, when ordering Products, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the billing information provided.

Pricing policy

We have taken great care in the preparation of the content of this Site, in particular to ensure that the details, descriptions and prices quoted are correct at the time of publishing. We charge your credit card or Paypal account when you place your order. Items in your online shopping cart will always reflect the most recent price displayed on the Product's detail page.

Availability

All Products are subject to availability. Validly stated prices on our Site remain in effect for so long as the Products are available or as otherwise stated on our Site. We will inform you as soon as possible if the goods you have ordered are not available.

Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.

Online ordering process

The ordering process consists of following steps:

• add the Products which you wish to purchase to your Shopping Cart;
• when finished adding items to your shopping cart, please proceed to checkout where you will complete the necessary information including but not limited to name, address, and other relevant details;
• before submitting your order, you will have a final opportunity to review the Products to be purchased and their prices (including any additional charges and fees such as delivery costs) and all of the information you have submitted; and
• you will click ‘Place Order’ to finalise your order. Note that all sales are final after you confirm your order and payment is processed.

Delivery

Deliveries can only be made within Hong Kong excluding outlying islands and restricted areas such as Lantau, Lamma Island, Chek Lap Kok, HK International Airport, Kwai Chung Container Terminals Cheung Chau, Ping Chau, Discovery Bay, Sha Tau Kok, Tai O, Mai Po, Ma Wan, Lam Kam Road, Ta Ku Ling, Sha Tau Kok, Lok Ma Chau, Lo Wu, Disney, and other restricted/areas. Not all of our delivery options are available to all areas of Hong Kong. If you have a question about delivery, please contact epopup@designtrust.hk. We will endeavour to deliver orders within 2-3 working days although this cannot be guaranteed.

Acknowledgement and acceptance of your order

We will notify you by email as soon as possible to acknowledge receipt of your order and to provide you with an order reference number. If we are unable to fulfil your order following this acknowledgement, we will contact you by email or telephone advising you of this. We will confirm acceptance of your order by sending you an e-mail that confirms that the Products have been dispatched ("Dispatch Confirmation"). If you require any information concerning your order please email epopup@designtrust.hk quoting your order reference number. We may not accept your order if an item you have ordered is out of stock.

Inspection

You should inspect the Products upon receipt and check that everything specified on the delivery note is included. You will be deemed to have accepted the order unless you notify us within 2 business days of delivery.

Payment

Payment can be made by any of the following methods: Visa, Mastercard, American Express, Union Pay, Discover and Paypal. Payment will be debited and cleared from your account at the point at which your order is dispatched. Please note that all credit cardholders are subject to validation checks and authorization by the issuer of the card. If the issuer of your payment card refuses to pay or does not for any reason authorize payment to DESIGN TRUST, we will not be liable for any delay or non-delivery of Products. We retain the legal ownership of all Products until full payment has been made by you and received by us.

Return & refund policy

No refund and exchange are allowed on discounted items. However, you do have a right to return and get a refund in respect of products that are faulty or damaged. You can receive full refund if your products are faulty within 7 days after the products have been delivered to you. Please contact us via epopup@designtrust.hk with your order reference number, and, the item(s) you wish to return. You will then be contacted by a member of our team to organize a pick-up of your order from the address you registered. You can choose to use your own carrier and will be liable for all return shipping costs involved. All returned item(s) should be packed securely to prevent damage in transit.

All returned goods will be examined upon receipt. We will not provide any refund if the goods show signs of unreasonable use. In such circumstances, we will notify you via telephone or e-mail that no refund will be given and you can choose to arrange for such goods to be returned to you within 14 days of our notification.

Should any returns being processed successfully, a credit note of full refund will be issued by DESIGN TRUST via e-mail, no later than 15 days after receipt of the returned goods.

Privacy policy

DESIGN TRUST values its customers and respects their privacy. Any information we collect about you is held with the utmost care and security. Your visit to our Site and your use of any of the services or features we provide is subject to our terms and conditions of which this privacy policy is part. This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

For the purposes of the applicable data protection laws, personal data means any information relating to an identified or identifiable individual; an identifiable person being one who can be identified, directly or indirectly (e.g. name and first name, date of birth, etc.) (“Personal Data”) and the data controller is DESIGN TRUST and whose registered office is 11F – 12F Tsim Sha Tsui Centre, Salisbury Road, Kowloon, Hong Kong.

This includes information you provide when you register to use our Site, subscribe to our membership or place an order on our Sites. This information may include your name, address, telephone number, email address and card information (if you wish to place an order on our Site). When you register with us you can view your Personal Data in ‘My Account’. You can access ‘My Account’ directly to amend any personal details, for example if you change your address. If you forget your password, simply click on the ‘Forgot Password’ link on the register or login page and an email containing your temporary password will be sent to the email address you originally provided.

We use Personal Data held about you in the following ways:

Information you give to us: we will use this information in relation to:

• Administration of our Site and performance of our service: The information you give us is necessary to enable us to (i) fulfil your order (including acknowledging your order and communicating with you if there is any issue regarding the fulfilment of your order); (ii) make sure your order is delivered correctly; (iii) maintain your account; (iv)accounting, billing, reporting and audit; (v) authentication and identity checks; (vi) credit, debit or other payment verification; (vii) debt collection; (viii) safety, security, health, training, legal and administrative purposes.
• Providing customer service in pursuit of our legitimate interest as a retailer: We ask for your contact details, such as your email address and telephone number and order details to enable us to answer any questions you have about using our Site and to notify you about the status of your order and other customer care services such as identifying your requirements and shopping preferences.
• Direct Marketing: We want to keep you up to date on our latest products, promotional offers and events in order to improve your shopping experience with us. We may use the information you provide and the information we collect about you to build a picture of your interests so that we may tailor our communications to you to ensure they are relevant and of interest to you.

Electronic Marketing: we will only contact you by electronic means (email or text) about goods and services.

Other Marketing: we will only contact you by post or telephone only if you have consented to this.

Data retention and destruction

We store data for as long as it is necessary to provide the products and services to you and others and so long as we are legally required to do so. Information associated with your account will be kept until your account is deleted, unless we no longer need the data to provide products and services, or until any legal requirements to keep it no longer exists. When we no longer need personal data, we securely delete and destroy it.

We have made every effort to display as accurately as possible the colour of the products that appear on the Site. However, as the actual colours you see will depend on your personal computer equipment, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the merchandise on delivery. To the extent permitted by applicable law, DESIGN TRUST disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this Site.

We reserve the right to change these terms & conditions from time to time. Any changes are effective immediately upon posting to the Site.
